These Terms of Use (“Terms”) are an agreement between you and Samir Kumar Shah, publishing Unsend under the Typhoon Labs name (“we,” “us,” or “our”) governing your use of Unsend and related services (the “Service”). By using the Service, you agree to these Terms and our Privacy Policy and Community Guidelines.
1. Eligibility
You must be at least 13 years old and meet any higher minimum age required in your country. If you are not old enough to enter a binding agreement, a parent or legal guardian must review and accept these Terms for you. Do not use the Service if applicable law prohibits you from doing so.
2. The Service
Unsend lets you write text, release it privately using visual effects, or intentionally publish it anonymously to a public community feed. Public posts may receive public replies. Features may change, be suspended, or be discontinued.
3. Public posting and anonymity
“Anonymous” means that Unsend does not display a public name or profile with your post. The app creates a private anonymous account identifier to support moderation, blocking, and deletion. Anonymity does not guarantee that content cannot identify you. Do not include personal information about yourself or others. Approved public content may be viewed, copied, saved, or shared by other people.
4. Your content and license
You retain ownership of content you submit. You represent that you have the rights needed to submit it and that it complies with these Terms. When you post or reply publicly, you grant us a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, distribute, and otherwise use that content only as needed to operate, improve, moderate, and promote the Service. This license ends when the content is deleted from our active systems, except for reasonable backups, legal records, and copies made by others.
5. Prohibited conduct
You may not submit or use the Service for content or conduct that:
- Threatens, harasses, bullies, stalks, exploits, or encourages harm.
- Contains sexual exploitation, especially involving minors.
- Promotes suicide, self-harm, eating disorders, or dangerous acts.
- Is hateful or dehumanizing toward protected groups.
- Contains another person’s private or identifying information.
- Is unlawful, defamatory, fraudulent, infringing, or deceptive.
- Is spam, advertising, solicitation, or repetitive disruption.
- Introduces malware, probes security, scrapes content, manipulates counters, or overwhelms the Service.
- Impersonates someone or falsely suggests endorsement.
6. Moderation
New posts and replies enter a private review queue before publication. We may review reports and use automated or manual tools to detect violations. We may reject, hide, remove, preserve, or disclose content; restrict access; or contact authorities when reasonably necessary. We are not obligated to publish or retain any content. Moderation may be imperfect, and you may encounter content you find objectionable. Report violations through the app or email typhoon.lab.app@gmail.com.
7. Removal requests
Instructions are available on our content deletion page. You can delete your own visible posts and replies in the app or delete your anonymous account and authored content in About. For older or pending content, you may need to provide the exact text and approximate posting time. We may refuse a request when we cannot reasonably locate or verify the content, or when retention is required by law or safety needs.
8. No professional or emergency service
The Service is intended for personal writing and community expression. It does not provide medical, mental-health, legal, or other professional advice. It is not monitored as an emergency or crisis service. If you or another person may be in immediate danger, contact local emergency services. In the United States and its territories, call or text 988 for the Suicide & Crisis Lifeline.
9. Intellectual property
The Service, including its software, design, branding, and non-user content, is owned by us or our licensors and protected by law. We give you a limited, revocable, nontransferable license to use the app for personal, noncommercial purposes under these Terms.
10. Third-party services
The Service relies on third-party platforms such as Apple, Expo, and Supabase. We are not responsible for third-party services, and their terms may also apply.
11. Disclaimer
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, noninfringement, availability, accuracy, and security. Some jurisdictions do not allow certain disclaimers, so these limitations may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Samir Kumar Shah, publishing Unsend under the Typhoon Labs name and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities, arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of USD $50 or the amount you paid us for the Service during the 12 months before the claim. These limits do not apply where prohibited by law.
13. Indemnity
To the extent permitted by law, you agree to defend and indemnify us against claims, liabilities, damages, and reasonable costs arising from your public content, unlawful use of the Service, or material violation of these Terms.
14. Termination
You may stop using the Service at any time. We may restrict or terminate access, remove content, or discontinue the Service when reasonably necessary to enforce these Terms, protect safety, comply with law, or operate the Service.
15. Governing law and disputes
These Terms are governed by the laws of Arkansas, United States, without regard to conflict-of-law rules. Courts located in Craighead County, Arkansas, United States will have exclusive jurisdiction, except where consumer law gives you the right to bring a claim elsewhere. Before filing a formal claim, contact typhoon.lab.app@gmail.com so we can try to resolve it informally.
16. Apple terms
If you use the iOS version, you acknowledge that these Terms are between you and us, not Apple. Apple is not responsible for the Service or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes
We may update these Terms. We will update the effective date and provide notice when required. Continued use after an update takes effect means you accept the updated Terms.
